Terms and Conditions

1. There is strictly no smoking within the property.

2. The Tenant warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 to Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, "a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday."

3. The Tenant shall not sub-let the premises or any part thereof.

4. The number of people occupying the premises shall not exceed those stated on the Booking Form.

5. The Tenant binds and obliges himself to vacate the hired premises without demand at the termination of the period of hire.

6. The Tenant binds and obliges himself to reimburse the Lessor in respect of any loss or damage beyond fair wear and tear.

7. The Hirer agrees that, in the event of cancellation, while every effort will be made by the Lessor to re-let, if a substitute cannot be found, the Hirer will be responsible for paying for the period of tenancy booked. Cancellation Insurance is strongly recommended to avoid this occurring.

8. The Lessor may treat the booking as cancelled if the balance of the payment is not sent by the date agreed in the booking agreement, and every effort will be made to re-let the vacancy.

9. The Tenant shall undertake to leave the property in a clean and tidy condition.

10. Pets, where allowed, must be kept under strict and proper control at all times.

11. The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to other residents or occupiers in the neighbourhood. In the event of a problem arising, the Landlord has the right to ask the Tenant to leave.

12. The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let and to do nothing which might vitiate the Landlord's Insurance Policy.

13. The Hirer undertakes to absolve the Lessor of any responsibility for accident, illness, injury or losses sustained while on the holiday property, however caused.

14. The booking is made on the understanding that the holiday property will be placed at the holidaymaker's disposal on the date stated on the Acknowledgement of Payment. Should this not be possible due to circumstances beyond the control of the property owners, we cannot guarantee to provide an alternative holiday property. In this case the rental you have paid will be returned to you in full and you will have no claim against the property owners.

15. The submission of the completed booking form and deposit payment shall constitute an offer by the holidaymaker and a contract shall only come into existence when the holiday property owner accepts the booking.
